Commission grants one‑year extension for six‑unit project at 1109 Circle City Drive

The Planning & Housing Commission voted to grant a one‑year extension for precise plan PP2019‑00009, which covers a proposed six‑unit apartment project at 1109 Circle City Drive.

Associate Planner Brendan Daldi summarized the project history: the precise plan was approved in April 2022, the property has changed ownership multiple times, and the current request would extend the plan into April 2027. Daldi said most review divisions had cleared the application and that, "if the applicant's very receptive to those comments and has a construction team already ready to go, I think it's feasible ... within the next 2 to 3 months, they could break ground."

Applicant Payman Rashan, who said he is a general contractor, told commissioners he intends to build immediately and had paid required fees as soon as he received authorization. Rashan said earlier delays stemmed from the seller's failure to deliver a permit‑ready project and that, after resolving authorization and permit transfer, he had been working with city staff daily to clear minor conditions.

Commissioners pressed on the standard in the municipal code that requires commencement of construction and diligent progress for extensions and discussed what constitutes ‘‘permit ready’’ versus fully approved permits. Staff reiterated that transfer of permit responsibilities from the prior owner delayed progress and that the new owner had recently resumed active work with the city.

The commission adopted Resolution 2686 granting a one‑year extension. Commissioners recorded a unanimous vote (4-0). The applicant said he expects to break ground as soon as minor conditions are signed off.
