Committee backs publishing new COMAR procedures for removal and appeal of county superintendents

Hana Oakley, State Board Deputy Director, presented proposed COMAR chapters to establish a dedicated procedure governing removals of local county superintendents by the State Superintendent and by local boards.
Oakley said the department and Board counsel reviewed the appeal and termination provisions and concluded the general appeals chapter did not include procedures suitable for the import of superintendent removal. The proposed chapters identify statutory causes for removal—immorality, misconduct in office, insubordination, incompetence, and willful neglect of duty—and set notice, documentation and timeline requirements for initial removal decisions and for a superintendent’s request for hearing and appeal to the State Board.
Oakley described the chapters as adding transparency and due-process safeguards and said the regulations delineate the initial removal process that occurs before an appeal to the State Board can be filed. Committee members moved, seconded and voted to recommend permission to publish the proposed chapters for public comment.
If the full State Board approves publication, the department will solicit public comment and retain these procedural safeguards in COMAR for future removal matters.
