Clarkdale rejects recorded Mountaingate trail easements, cites restricted access and maintenance burdens

Assistant Town Manager Ruth May told the council that staff recommend rejecting easement dedications recorded by the Mountaingate HOA and Mountaingate Clarkdale LLC because of legal and practical problems. May said the plat language ties the trails "specifically to the residents and their invitees" and does not dedicate them for public use; the development agreement is ambiguous and can be amended by private parties, which undermines any town acceptance tied to those covenants.

May showed a slide contrasting the exhibit map (showing proposed trails) with what was actually built and said some segments were never constructed or are sited in washes and draws where trails "will never be built" and there are no designated trailheads or parking for non-residents. She said the town lacks staff capacity to maintain new trails and that the recorded one-sided documents required corrective action; legal fees to assemble and review the response documents were already around $2,000 and councilors later referenced total staff and legal costs approaching $4,500–$4,700.

Council members asked how to prevent similar unilateral recordations in the future. Members suggested language in future development agreements explicitly requiring the town to sign any dedication "prior to recordation" and said the development agreement already ties acceptance to the town's acceptance clause; May and other staff agreed to strengthen future wording so recordation cannot precede council acceptance.

Council Member Jones moved and Council Member O'Neal seconded a motion to approve the rejection of the easements recorded by Mountaingate HOA and Mountaingate Clarkdale LLC, authorize the mayor and clerk to execute documents recording the rejection, and direct the clerk to record them immediately upon execution. The motion carried by voice vote.
