The Moraine Board of Zoning Appeals unanimously approved two variances at its April 7 meeting, granting permission for a front deck at 2901 Lakehurst Court and a carport at 3308 Clearview.
Staff told the board the appellant in case BZA2026-01 requested a wooden front deck that would reduce the required front-yard depth under Moraine Codified Ordinances (MCO) section 1137.03(B)(1)(A) from 25 feet to about 14 feet 6 inches. The Technical Review Committee met March 27, 2026 and reported no objection. Neighbor Shirley Whip of 2905 Lakehurst Court, sworn as a witness, said she is the closest neighbor and has “absolutely no objection.”
For case BZA2026-02, staff said the appellant sought multiple variances under MCO chapter 1181 regarding accessory structures: the proposed carport at 3308 Clearview would sit less than 3 feet from a lot line, less than 10 feet from the principal structure, would be in a side yard and closer than the 60-foot front-lot-line distance normally required. Staff again noted the Technical Review Committee had no objection. Mrs. Smith, sworn before speaking, said she needs the carport because she is disabled, cannot shovel snow, and missed a doctor’s appointment when she could not access her car; she told the board she has a doctor’s note supporting the need.
After brief public comment and no questions from board members, a motion to approve BZA2026-01 passed by roll call with four Yes votes (Mrs. Bond, Mrs. Dove, Mr. Hamilton and Mr. Kemper). The board then moved and seconded approval of BZA2026-02; that motion also passed on a 4-0 roll-call vote. The chair noted no further business and adjourned the meeting around 6:08–6:09 p.m.
The hearings and votes were procedural approvals of the variances requested; no recorded conditions or amendments were stated during the meeting record.
