Council hears planning staff on downtown restaurant CUP, a continuance request and a special‑events area resolution

Planning staff presented three items during the April 14 work session: a conditional‑use request for a new downtown restaurant (Black Eyed Peas) seeking on‑premise alcohol and live entertainment; a requested continuance for Frank & Patty’s (a conditional use at 9565 Shore Drive) to resolve outdoor/amplified‑music conditions; and a resolution to designate an extended special event area for a downtown activation labelled CLT 50.

For Black Eyed Peas (241 Granby St.), staff said the applicant seeks permission to operate 8 a.m. to midnight seven days a week (with a 1 a.m. allowance on New Year’s) and to provide background music or limited entertainment; the planning commission recommended approval. Council members pressed for clarity about whether a DJ would be engaged as background music only or would constitute entertainment under the zoning code (which defines a DJ as an entertainer when the role is to perform rather than simply play background music). Staff noted the conditional‑use approval typically includes a two‑year expiration for new businesses and discussed enforcement/remedies if the activity exceeds the permit.

On Frank & Patty’s (9565 Shore Drive), staff said the applicant requests a continuance to work through concerns raised during the planning hearing about off‑premise sales and outdoor amplified sound; the planning commission recommended approval with a condition prohibiting amplified outdoor music to mitigate neighborhood concerns.

Staff also presented a resolution to declare an extended special event area for CLT 50, describing the boundaries (Paul’s to the east, Brambleton to the north, the Elizabeth River to the south and the Chelsea Business District included) and explaining that businesses inside that area could use modified permitting procedures for downtown activations.
