The Red Bank Board of Adjustments moved on Nov. 20 to carry the application for 240 Shbury Avenue to Jan. 15, 2026 at 6:30 p.m. after discussing the sufficiency of legal notice to nearby residents.
Board counsel reported that the applicant's attorney, Ed McKenna, asked for an adjournment earlier in the day and had consented to extend the statutory time the board has to act. Counsel proposed carrying the application to Jan. 15, 2026, and the board then examined whether required notices had been sent to nearby property owners.
A board member stated that they had not received notice and believed they lived within 200 feet of the lot; the board secretary and staff said they would check the notice list and addresses. Given the elapsed time before the next meeting and the uncertainty about notice to all required recipients, the board voted to require fresh public notice and to carry the application to the Jan. 15 meeting. Board members also discussed recusal for any member who sits within the required notice radius.
The board recorded the carry in open session and instructed staff to provide new notice for the rescheduled hearing. The applicant's attorney had indicated Jan. 15 would work for scheduling. No final determination on the application itself was made at the Nov. 20 meeting.
