The Highlands Borough Land Use Board voted to approve an amendment to a prior resolution for 123 Bay Avenue (item 25-04), allowing the applicant to use the current ordinance’s permitted hours rather than the tighter limits that had been placed on the earlier approval.
Megan, appearing for the applicant, told the board the applicant seeks to utilize the already approved ordinance to change hours of operation. The revised hours cited in the hearing included Sunday through Wednesday 8:00 a.m. to 9:00 p.m.; board members asked whether town or state rules would otherwise limit those hours. Staff said the revised schedule meets state requirements and explained the prior approval had limited Sunday hours because a neighboring church and associated school used to operate nearby — a condition that no longer applies because the church property was sold.
The board moved and voted to approve the amendment. The transcript records an abstention by Miss Chang and affirmative votes from other members listed in roll call.
At the hearing the applicant noted plans for a CRC inspection on May 5 and expected to open weeks after that inspection. The board did not place additional restrictions on the amended approval during the meeting.
