The Planning and Zoning Commission unanimously approved V252 on Feb. 11, granting a 0.482‑acre variance from the village’s 1‑acre lot‑size requirement to permit consolidation of four existing MRGCD tracks at 8422 Rio Grand Boulevard.
Planning consultant Brennan Williams told commissioners the four tracks predate the village’s one‑acre standard (adopted in 1972) and that the current configuration prevents lawful permits for routine improvements. Staff recommended approval, concluding the nonconforming track configuration meets the code’s unnecessary‑hardship criteria because no reasonable use can be made without relief.
Applicants Andrew McGibbon and Avery Bingham said they purchased the property and have been unable to finish modest interior work (they described adding a closet) because platting and permit processes are blocked by the current lot lines. "We started the platting process almost two years ago," McGibbon said, and the applicants told the commission they halted construction when advised the lot‑size issue must be resolved before continuing.
Commission discussion focused on the hardship standard and the practical inability to obtain permits until replating occurs. Commissioners said the application fit the intent of the variance criteria and moved to approve. The motion carried on a roll‑call vote with all commissioners voting in favor.
As approved, the variance allows the applicants to proceed with platting to consolidate the four MRGCD tracks into a single lot; subsequent platting and building permits remain subject to village platting review and any other applicable approvals.
