Board fines server $100 after underage-sale compliance check at Leonardtown restaurant

County attorney Christopher Beaver summarized the enforcement unit's report, saying officers used a confidential informant who was seated with Corporal Jamie Davis and Sergeant Robert Merritt and ordered a bottle of Bud Light that was served by Davis. Deputy Steven Meyers said officers later made contact and Davis admitted she had not checked for identification.
"I was just negligent and forgot to ID her," Davis told the board, expressing remorse and saying she had returned to work and would now ID every customer regardless of age.
Board members debated penalties after hearing testimony. An initial motion to assess a $150 fine failed; a subsequent motion for a $100 fine passed unanimously. The board told Davis she has 10 days to pay the fine and may appeal the decision to the Circuit Court for St. Mary's County within 30 days.
The board cited a violation of 6-304 of the Alcoholic Beverages Article of the Annotated Code of Maryland and board regulation 5.04J (failure to verify age) as the basis for the action.
No member requested additional sanctions or license action against the establishment; photographic evidence and the transaction receipt were recorded by enforcement officers and placed into evidence, and the alcoholic beverage at issue was discarded by restaurant staff.
The board's action concluded the hearing on that violation; the enforcement coordinator may prepare an offense report and the licensee/employee were summoned to appear before the board as part of the compliance process.
