Richmond BZA approves variance for accessory structure at 2320 Flatley Road

The Richmond Board of Zoning Appeals voted unanimously to approve a variance (BZA 9-2026) on April 8 allowing a 1,600-square-foot accessory structure at 2320 Flatley Road with reduced setbacks in the high-intensity industrial (I-2) zoning district.
Planning staff told the board the petition by property owner Shawn Stapleton would reduce the required side-yard setback from the I-2 standard of 20 feet to 10 feet on the south side and reduce the rear-yard setback from 30 feet to 13 feet on the west side. Staff recommended approval after notifying 25 adjacent property owners and receiving one written expression of support from John Osborne of 2332 Flatley Road.
"I'm just wanting to extend my building just for residential use for storage," applicant Shawn Stapleton said when he addressed the board. Planning staff said the request is consistent with the industrial character of the surrounding area and that it is not expected to generate significant noise, traffic or lighting impacts.
Staff noted a high-voltage electric line west of the proposed accessory structure and said staff had contacted the homeowner to address that safety consideration. As conditions of approval, the board required (1) issuance of an Improvement Location Permit and building permit by the infrastructure and development department before construction begins, and (2) contact with sanitation to obtain any required stormwater permit.
A motion to approve BZA 9-2026 "based on the staff report and two written commitments" was made and seconded (the record does not identify the mover and seconder). In a roll-call vote, Josh Imhoff, Sherry Euler Hemingway, Nathan Sheets and Rob Tidrow voted in favor; Jeff Cook was recorded absent. The motion carried and the variance was approved.
The board closed the meeting after announcing the filing deadline for the May 13, 2026 BZA hearing; staff indicated two or three applications had already been filed for that meeting.
