City project staff Kyle described a proposed 75-by-400-foot easement to grant access for a school site. City Attorney Rolf explained options for protecting the city’s interests: a temporary easement, a perpetual easement conditioned on the land being used for a school, termination upon property transfer without city consent, or a fixed review period (council discussion suggested five years as an option).
Council members emphasized that the easement should be limited to school purposes and nontransferable without city consent; if the school is not built or the property is transferred, the easement should terminate. Council approved a resolution directing the city attorney to prepare an easement that allows the school access while protecting the city through termination triggers and nontransferability language.
Staff said the change mirrors prior exchanges where the city accepted easements from the school for other projects and that the proposed draft will include specific termination events and notice periods. The resolution was approved by roll call.
