Florence council approves placing APS franchise question on Nov. ballot

The Florence Town Council voted Tuesday to place a 25-year franchise agreement with Arizona Public Service (APS) on the November 3, 2026 ballot.

Town staff summarized key terms of the proposed franchise agreement: APS would have the right to use public rights-of-way, be responsible for returning areas excavated to the same condition, comply with town codes and permitting, carry insurance naming the Town of Florence, coordinate relocations for capital projects, and pay a proposed 2% franchise fee to the town. The franchise would be subject to voter approval.

Miss Garcia opened the discussion and said the town clerk’s office will prepare a publicity pamphlet to explain the ballot question to voters. Richie Rosales of APS attended the meeting and council members thanked APS for past community support programs and grants.

Vice Mayor Adam and other council members framed the ballot referral as an example of partnering with a utility while giving voters the final decision. The council adopted Resolution 1987 by motion and voice vote with no recorded opposition.

The council directed staff to conduct the required notice and to produce informational materials for voters ahead of the November election. No legal challenge or public opposition was reported at the meeting; members said they will continue outreach with local stakeholders.

The ballot language the council approved to submit to electors reads, in part, that voters will decide whether a franchise should be granted to APS to construct, maintain and operate an electrical utility system in the town in accordance with the agreement submitted by the mayor and council.
