Committee approves limited DOE intervention for financially distressed districts

The House Education Committee unanimously adopted an amendment to HB1816 clarifying the Department of Education’s role when a school or district is in financial emergency, and voted to place the bill on the consent calendar.
Representative Lad, sponsor of the bill, said the amendment (0983H) clarifies that the state board may deem a district in financial emergency and that the commissioner may assist by developing and overseeing a recovery plan and ‘‘leverage resources to address core financial needs.’’ The amendment adds language emphasizing corrective and technical assistance and limits department oversight terms (for example, up to one year), officials said.
Members urged careful drafting and clear committee report language to ensure the statute does not permit the department to take over routine daily operations. Representative Bluno asked that the committee report explicitly state the department’s intent to provide limited assistance, not a takeover; Representative Lad agreed to include clarifying language in the report.
The amendment passed on a unanimous voice/show‑of‑hands vote and the full OTPA motion on the bill (as amended) was approved on roll call. The committee placed HB1816 on the consent calendar.
