Plan commission approves Legacy Autos permit with paving and screening conditions after neighbors cite lighting concerns

The Delavan Plan Commission recommended approval of an amendment to a group development conditional use permit that will allow Legacy Autos to operate vehicle sales with outdoor display at 1333 Rine Street, subject to conditions intended to limit neighborhood impacts.
Staff said the outdoor display area must be paved and fenced, per code, and recommended a condition requiring paving no later than Oct. 31 and submission of a paving contract by Aug. 1. Staff also required maintenance or replacement of landscaping along the north property line to screen the display area from adjacent multifamily residences, restricted storage of inoperable vehicles, and noted that any future lighting must comply with the city’s dark‑sky standard.
Alexis Verdusco, owner and general manager of Legacy Auto Sales, said she rents the space and intends to comply: “I will meet what’s required and make sure we are in compliance.”
Neighbor Oscar Mueller testified he lives directly west of the display area and expressed concerns about visibility and lighting, saying some nearby businesses’ exterior lighting is “obnoxious.” Jerry Garcia, the building owner, asked whether the commission favored a privacy fence or taller shrubs; staff suggested an 8‑foot solid privacy fence or evergreen plantings such as arborvitae as possible screening solutions.
Commissioners discussed whether additional screening to the west should be required beyond the north‑line screening staff recommended. The commission amended the conditions to require an agreed screening solution (either an 8‑foot privacy fence or evergreen landscaping) to be resolved between the applicant and staff before proceeding. The motion recommending approval carried.
The permit includes deadlines for paving and requires the owner or tenant to provide proof of paving arrangements. Any future proposed exterior lighting would require an amendment to the conditional use permit.
