City Attorney counsel explained the Personnel Review Board had found the discipline appropriate and that an employee may appeal that decision to council. Counsel said the appeal is the procedural first step and recommended the council decide whether it wants to hear the appeal and how the discussion should occur.
A central point of debate was whether discussion of "good name and character" can legally happen in executive session. The city attorney told the council that by appealing to council, an employee may have waived any confidentiality tied to "good name and character," but that the council may clarify the ordinance's intent and opt to treat some discussions privately. "If the council determines that this is something that should be done privately... you certainly can clarify that," counsel said.
Council members asked for a one-page checklist and a draft resolution clarifying options for Monday. Legal staff said they would provide sample resolutions: one clarifying whether executive session is appropriate and another specifying hearing procedures and whether counsel may present arguments (the latter would occur in public if adopted). Counsel emphasized that no new evidence should be introduced at the council review because the review is limited to the record considered by the Personnel Review Board.
