Commission tables proposed gas-station setback ordinance for clearer language and staff input

Laredo commissioners voted to table an ordinance that would add setback rules to the city's land development code limiting how close gas stations can be to residences, schools and daycare facilities.

The ordinance as introduced would impose 100-foot or 200-foot minimum distances depending on tank capacity, but several commissioners flagged a discrepancy between the agenda packet caption (which referenced emissions) and the ordinance language in the packet. Commissioners said the text did not make clear whether required distances would be measured from the property boundary or from the tank "injection point." Commissioners asked environmental staff and the legal department to return with clearer wording and supporting documents.

Commissioners said the ordinance had been drafted by the legal department and requested that Mr. Wagner, the director for environmental (referenced in the discussion), provide a presentation or supporting materials explaining technical terms and the measurement point. One commissioner summarized the concern this way: "the 100 feet or the 200 feet distances will be measured not from the property line upon which the gas station is placed but from the injection point where the... gas is injected into the tanks themselves," and asked that the explanation be clarified in plain language.

After discussion, a commissioner moved, and the motion was seconded, to table the item and bring it back with clarified language and supporting explanation; the motion passed by voice vote. The commission closed the public hearing and agreed to invite environmental and legal staff to the next presentation on the item.
