The Town of Charlton Planning Board voted March 4 to grant a temporary certificate of occupancy to Boston Outdoor Living on the condition that the company submit a performance bond, report progress to the board on May 20 and finish all remaining site work by June 17.
The applicant told the board that interior trade inspections — plumbing, electrical, HVAC and the septic — have been signed off and that the building is "essentially done," but that exterior work including final asphalt, landscaping and a driveway entrance curb remain delayed by winter weather and MassDOT coordination. The applicant provided a letter from the paving contractor and said a performance bond could be delivered to the office the next day.
"If the building's safe, the trade inspectors are signed off and the planning board okays it, then I can sign a certificate," the Building Commissioner said, describing the office's legal role and limits on revoking occupancy once tenants move in. The board discussed enforcement options if conditions are not met, including drawing on the bond or pursuing legal remedies, and emphasized the difficulty of rescinding a temporary occupancy after the building is occupied.
A board member moved to approve the temporary occupancy contingent on a bond, a May 20 update to the board, and completion of work by June 17; the motion was seconded and the board approved it. The board directed staff to place the applicant on the May 20 agenda for a status report and indicated that the chair or director could sign the certificate once the bond and other required paperwork were on file.
The board recorded that the applicant estimated final paving and landscaping would likely be completed in mid- to late April if weather cooperated, but agreed to the later June 17 completion deadline to allow for weather-related delays. The applicant said the performance bond documentation would be provided promptly.
