Germantown postpones ordinance update as trustees ask staff to draft retroactive pond maintenance language

Trustees raised practical and legal questions about retroactive application: who would pay for removal of silt or contaminated sediment, how to identify responsible owners (HOAs vs. adjacent landowners), how the village would enforce retroactive obligations, and whether dredging would require specialized contractors and additional funding.
Staff and trustees noted a prior outreach effort that contacted pond owners via the GIS owner database; about a third of recipients responded and many reported proactive maintenance. The DNR expects ponds be inspected at least once every five years to meet permit requirements; the committee asked staff to work with the village attorney to draft potential language and an outreach plan and to return with recommended options and legal analysis.
The committee voted unanimously to postpone the item and requested staff provide attorney guidance on retroactivity and a proposed schedule to inspect and track pond maintenance going forward.
Next steps: staff will consult with the village attorney, refine ordinance language options for retroactive application, develop an inspection schedule tied to DNR expectations and return to the committee with draft amendments and an outreach plan for pond owners.
