Resident asks Middleton council to investigate developer agreement on Duff/Highway 44 turn lane and $133,000 payment

During public comment at the March 4 Middleton City Council meeting, resident Cheryl Palange urged the council to investigate a passage in the minutes of a prior meeting and to determine whether a developer agreement or a prior mayoral decision effectively removed a required safety improvement at Duff and Highway 44.

Palange said she reviewed council agendas and minutes from the two years Mayor Hutcherson served and "could not find a record of the city removing a road improvement or taking money in lieu of the road safety work being completed." She asked the council to "investigate the matter, determine whether the transaction can be reversed so that the required safety improvements can be made."

Planning staff responded in the meeting, saying the option to take $133,000 in lieu of building the turn lane was included in the original development agreement and that Mayor Hutcherson had exercised that option under terms of the agreement. Staff said the developer agreement and an email from Mayor Hutcherson documenting the choice exist and that they would provide that documentation to council members.

Council members and staff noted that final plat approvals and development agreements are distinct procedural steps: a final plat is typically ministerial if infrastructure and code requirements have been satisfied, while developer‑agreement terms negotiated earlier can include timing and alternatives for improvements. Staff stressed coordination will be needed with Highway District 4 and the Idaho Transportation Department for a traffic signal or right‑of‑way work at Duff/Highway 44.

The claim in public comment was not resolved during the meeting. Council directed staff to share the referenced records and said they would review the documentation to determine whether any additional council action is required.
