Charlottesville delays public hearing on real property tax rate after notice error; council amends agenda

A representative from the city attorney's office told the Charlottesville City Council on April 7, 2025 that staff had failed to timely post the public notice required for a hearing on the real property tax rate and recommended removing the hearing from the night's agenda.
The city attorney's representative said Virginia Code §58.1-3321C requires notice to be published in a newspaper of general circulation and posted in a prominent public location in the building where the governing body meets at least seven days before a public hearing on increases to the real property tax rate. "There was indeed a failure to timely post notice of public hearing in a prominent public location," the office said.
Council voted to amend the agenda consistent with that recommendation. The motion to amend the agenda passed 5 to 0. Staff said anyone who wished to speak about the tax-rate issue would still be permitted to do so that evening, and that the city would republish notice and schedule the hearing for the council's next regular meeting on April 21, 2025, should council approve.
The council then proceeded with a scheduled work session and the ADA presentation. The record shows staff will republish notice in the daily newspaper and in the prominently posted location in city hall so the rescheduled hearing will meet the seven-day posting requirement.
