The Eagle Pass Zoning Commission unanimously approved a sidewalk-waiver request on April 9 for a replat in the extraterritorial jurisdiction (ETJ) along FM 2030, finding the case consistent with past county decisions where curb-and-gutter is absent.
Civil engineer Carlo Vad, who identified himself during the hearing, represented applicants Myra Varentos and Jose Armando Lopez and described the replat for Chila Vista Block 5 (proposed lots 5A and 5B). Vad told the commission the Maverick County Commissioner Court had already approved the plat as presented and that the subject frontage lacks curb-and-gutter, a condition that in prior cases has led staff to recommend waivers within the ETJ.
Planning staff recommended granting the waiver on the same consistency grounds. Commissioners discussed whether the city and county had applied rules uniformly but staff said the difference stemmed from jurisdictional context: the subject lots are in the ETJ and county practice has been to waive sidewalk requirements where curb-and-gutter is not present.
After closing the public hearing, a commissioner moved to approve the waiver and the motion passed.
What happens next: The approved waiver will be recorded consistent with the county’s action; if future development or infrastructure (curb-and-gutter) occurs, sidewalks could be required on replatted or newly developed parcels.
