Facing sustained public comment and technical debate, the Saco Planning Board on March 3 granted preliminary subdivision, site-plan and conditional-use approval for a 25-unit condominium-style development at 42 Ferry Road (map 22, lot 34), subject to conditions and one waiver. The vote on the approvals was 5 in favor, 0 opposed with one abstention.
Applicant engineers from Acorn Engineering summarized plan revisions since the last session, noting updated landscape plans, peer reviews (legal, environmental, hydrogeologic and traffic), and a commitment to extend a tree survey and to install a crosswalk and sidewalk connection to Pine Ridge Road. Craig of Acorn said the applicant would work with staff and peer reviewers on an all-way stop or alternative pedestrian controls if required.
Neighbors and abutters—several of whom live directly below or adjacent to the site—testified at length. They asked for additional hydrologic and hydrogeologic analysis, argued that existing on-site and off-site drainage and a spring-fed pond are more extensive than the plans show, and warned that concentrated outfalls could worsen flooding on their properties. Maggie Mandac and others requested greater buffer widths, a mapped survey of trees extending 10 feet beyond the property line, and stronger assurances about long-term performance and maintenance of stormwater Best Management Practices (BMPs).
The transcript shows repeated concerns over the location and historical significance of "Seal Rock Spring" (a feature referenced in the city’s resource-protection overlay). Some abutters provided historical surveys and photographs and urged the city to commission a study to precisely locate any spring heads. City staff and the zoning administrator noted that Seal Rock Spring is mapped in the city's ordinance and zoning map based on prior surveys; staff said that a formal hydrogeologic assessment is not required by ordinance for this application but "may" be requested by the board.
In board deliberations, members weighed peer-review findings, the limits of municipal authority to require off-parcel studies, and the balance between on-site open space (including a pool and poolhouse the applicant proposes) and protective buffers. The board voted to grant a waiver from the landscaping/buffering requirement in Section 188-711 A6 related to buffers between buildings (6-0), found the open-space provision acceptable without an off-site fee (6-0), and adopted staff findings and conditions (vote 5-0 with one abstention). The applicant must deliver updated plans showing the sidewalk/crosswalk connection (or an approved alternative) for final review; staff included a condition that the board, DOT and city staff review and approve the final crossing treatment and any required off-site improvements.
The board's approval is preliminary; the final subdivision and site-plan approvals remain contingent on satisfying conditions including: an updated tree survey (including trees 10 ft beyond the property line), updated financial and utility capacity documentation, and plan-level detail for stormwater measures and off-site pedestrian connections. One board member abstained from the final votes.
