The Town of Brookline Select Board on Dec. 3 approved a noise-bylaw waiver that will allow Kaplan Construction to perform primarily interior HVAC upgrade work at a childcare facility at 10 Linux St. during off-hours for a short period, subject to conditions intended to limit neighborhood disruption.
Kaplan project manager Jacqueline Maloney and Kaplan President Nathan Peek told the board the work requires interior access outside normal daycare hours to avoid disrupting children and staff. Peek said the overnight crews would be small — typically two to four workers — using hand tools and electric screw guns, and that the full off-hours window requested represented a conservative estimate; actual off-hours work, they said, would likely be two to three weeks.
Neighbors including Dr. Al Lang and Susan Williams opposed the overnight schedule, citing repeated nearby construction and the risk of trucks, backup beepers and late-night disturbance around the holidays. "It is kind of really very vexing that around the Christmas time... they want to be working at night," a neighbor told the board.
Board members pressed the applicant on the scope and timing and asked staff to condition any waiver on adherence to the letter submitted, rapid response to complaints and limiting loud exterior work to daytime hours and weekends. The board approved the waiver on a roll-call vote with one recorded dissent, emphasizing neighbor recourse to Inspectional Services if noise exceeded permitted levels.
Next steps: Kaplan will proceed under the terms of the waiver; neighbors were advised to call Inspectional Services with violations. Staff will monitor complaints and report back if issues arise.
