Tequesta council adopts ordinance to codify reasonable-accommodation process for certified recovery residences

On second reading the Village Council adopted Ordinance 12-25, amending Chapter 22 (Community Development) to codify the village’s reasonable-accommodation process for housing requests, including those related to certified recovery residences, in response to amendments to Florida Statute section 397.487.
Dylan (village attorney) read the ordinance title and explained that the village previously had a 2017 resolution and that the ordinance places the existing process into the code and adds language required by the state. "The village already had its reasonable accommodation policy which you all adopted via resolution... essentially what's happening here is we are just taking that existing policy and codifying it within your code of ordinances and adding the provisions required by state law," Dylan said.
Council members asked operational questions about whether any certified recovery residences currently exist inside Tequesta (staff said none were known in the village) and sought clarity on administration, parking requirements, and how requests are reviewed. One council member, identifying work in law enforcement, urged careful monitoring of any future recovery residence applications and suggested bringing certain requests to Council for review rather than handling entirely at staff level.
Staff noted the village must adopt the ordinance to comply with the statutory deadline and that the council could revisit and amend the ordinance or its procedures after adoption. The council approved the ordinance by voice vote.
