The Town of Southwest Ranches announced at the council meeting that a federal judge dismissed all claims in Atlas Investments’ lawsuit against the town and several officials.
Town legal counsel said the case, filed in March 2025, alleged a range of constitutional and other claims arising from the town’s enforcement actions against the plaintiff’s property. The judge’s written order, read into the record by the town attorney, said that even when stripped of puffery the amended complaint failed to show the "conscience-shocking" conduct required for substantive-due-process or equal-protection claims and that further amendment to the complaint would be futile. Counsel from the Florida League of Cities’ insurance defense team was credited for the representation and a prompt dismissal.
Council members congratulated the town attorney and defense counsel. The town attorney said the town may discuss claims for attorney fees with the insurance counsel outside the public meeting.
No damages were awarded in the public record excerpt and the court’s order declining leave to amend was described as final enough to end the town’s exposure on the asserted federal claims at this stage.
