Scott County Board revokes interim-use permit for home-based trucking business after repeated violations

Scott County commissioners voted to revoke an interim use permit for a home-based trucking business, citing repeated violations of conditions that required operations to follow the approved business narrative, store business vehicles inside, and limit the number of business vehicles on site.
County planning staff told the board that interim use permit 2023-003, issued in March 2023 for a trucking operation at 1776 Langford Boulevard, contained 12 conditions. Staff said inspections and photographs accompanied three successive notices of violation (the final notice set Jan. 15, 2026 as a compliance deadline) and documented breaches of conditions five, seven and nine, including outside storage of trucks, trailers and other vehicles.
Marty, the county staff member who presented the case, said the permit required the business to follow the applicant’s narrative and to keep business vehicles inside. “For the past two years, Mr. Peterson has been in violation of conditions five, seven, and nine of that permit,” Marty told commissioners, summarizing the enforcement record and the planning commission’s recommendation to revoke.
During board discussion commissioners asked about enforcement steps beyond permit revocation; staff said criminal citation was likely to be pursued and civil remedies would be considered in consultation with the county attorney. Commissioner Beer asked whether Mr. Peterson had attended the Planning Commission review; staff said he had not and had been notified by mail and phone.
A motion to revoke interim use permit 2023-003 was made and seconded; the board approved the motion by voice vote. The record shows the Planning Commission and the Spring Lake Town Board had both recommended revocation following the notices of violation and the documented outdoor storage of business vehicles.
The board also tabled a separate consent-agenda land conveyance item to March 17 so staff and the township could complete coordination. The revocation is a formal enforcement action; county staff said they would pursue citations and other steps to secure compliance.
