Staff said the zoning code allows open‑style fences in public easements if they will not “substantially or materially interfere with drainage flow,” and recommended approval provided the homeowner obtains the subdivision homeowners‑association (HOA) letter of support. Commissioners expressed concern that the packet lacked any hydraulic or site‑specific analysis showing whether the proposed fence would impede surface overflow to nearby detention ponds.
Commissioner Bob pressed the point: “I can’t sit here and approve something anymore without that analysis,” he said, warning that repeated approvals without review could create “little time bombs throughout our village.” Commissioner Bridget urged a short, staff‑level verification rather than requiring owners to hire private engineers: “A verification — like a high level verification that this isn’t going to impede the flow — is appropriate,” she said.
Staff and public‑works personnel discussed whether the easement contains a recorded pipe and whether that pipe and an overland overflow path serve different storm events; engineers noted that an underground pipe often handles smaller (10‑year) storms while a 100‑year event uses a surface overflow route to reach detention ponds. Commissioners said that if the pipe conveys the runoff year‑round and a suitable vertical separation exists between pipe and fence footings, the risk is lower, but an engineering check is still warranted.
After discussion the commission approved the permit with six total conditions incorporated into the staff recommendation, including the HOA approval and the specific additional condition that the village engineer verify the fence’s lowest opening (the 4‑inch gap) will not restrict drainage flow; staff said that if the verification shows adjustments are needed the permit or fence design would be revised before installation.
The action resolves one of a series of similar requests in Renwood subdivision and establishes an administrative precedent that staff and village engineers will perform a quick feasibility check before certain fence permits in drainage easements proceed without requiring homeowners to hire private consultants.
