The Lebanon City Planning Commission on Monday recommended that the city council approve a special-use permit allowing Robert Smith to operate a seasonal fireworks stand between Dairy Queen and Shell.
Smith told the commission he would sell only consumer-grade fireworks, keep inventory locked in a container and display items under a tent. "My big goal is to make sure that our community has safe and legal fireworks," he said, adding he planned to open about two weeks before July 4 and remain a few days after the holiday for cleanup.
Commissioners and audience members questioned operating hours and enforcement. An audience member said neighborhood enforcement has been inconsistent and described noise and safety concerns around unofficial fireworks; commissioners discussed reasonable closing times and the limits of police enforcement. Staff noted that the city ordinance provides for special-use permits and that sales would be taxable.
After discussion a commissioner moved to recommend approval; the motion was seconded and the commission carried the recommendation. The commission agreed to forward the recommendation to the city council, which is scheduled to take up the item at its next meeting on Monday, the 14th.
The recommendation does not itself authorize sales; final approval and any permit conditions (hours, security, duration) will be set by the city council and the city as licensing authority.
