Board approves developer-funded extension of Piney River water and sewer for Jenny’s Creek subdivision

The board voted to approve a developer proposal from Jenny’s Creek LLC to extend water and sewer service in Piney River, accepting a draft developer agreement that requires the developer to install roughly 631 feet of sanitary force main and 639 feet of 2-inch public water main to serve seven lots.
Staff explained the work will be constructed at no cost to the county, with the infrastructure turned over to county ownership after installation and inspection. The proposal was presented as necessary to satisfy Nelson County ordinance connection requirements when buildings are within 1,000 feet of public utilities. "No cost to the county. Correct. He covers all the cost of installation...and the subsequent connection fees," a staff presenter said when summarizing the proposal.
A supervisor declared a conflict of interest and temporarily removed themselves from the discussion because they are under contract to purchase two parcels affected by the proposal; that recusal was noted for the record. Supervisors moved to adopt Resolution R2026-15, approving the expansion of the Piney River water and sewer system to accommodate the Jenny’s Creek subdivision, and the motion carried by voice vote.
The resolution authorizes staff to finalize the developer agreement and proceed with required approvals as the subdivision moves through planning and zoning review.
