Council delays Pilion Creek construction-manager amendment to April 7 for fuller public review

The Omaha City Council voted 7–0 to lay over consideration of Amendment No. 1 to the construction manager-at-risk agreement with McCarthy Building Companies for the Pilion Creek Water Resource Recovery Facility secondary expansion until its April 7 meeting.
Council member Melton moved to lay the item over, saying staff and the city attorney’s office needed more time and that council members should have the amendment available for public review before voting. "I suggest that we lay this over so that we have an opportunity to review the amendment of the whole," Melton said.
Several members, including Council member Harding, supported the layover, noting outstanding questions about changes in language from the original agreement and requests for time for McCarthy to respond. Harding said the key issue was whether the amendment allowed work that was not part of the original self-performed scope and that councilors had received many follow-up questions after prior meetings.
The council also laid over a related agenda item covering the builder’s risk insurance policy (item 27) to April 7 so the insurance terms and the construction-manager amendment could be considered together. Council members said moving both items together would give the public and council time to review any substantive changes and ensure transparent consideration.
The item will return April 7 with the amendment of the whole available for public inspection, and council members asked staff to ensure adequate time for review ahead of that meeting.
