Winnebago County supervisors reopened a zoning item on a property owned by a person identified as Benny and said they would wait for legal counsel before taking further action.
Matt, who participants identified as the attorney advising Benny, told the board the Board of Adjustment had approved the application and that he and Benny would work with counsel and the county on fence specifications. Matt said the parties planned to meet within the next week or two to finalize "what kind of fence and what that's going to look like," including height and setback details meant to preserve sight lines at a nearby stop sign and address drifting concerns raised by Secondary Roads.
Supervisors stressed their primary levers are budgetary and regulatory. They noted Secondary Roads had raised concerns about snow drifting and sight visibility if fencing sits too close to the right-of-way; the board asked that the proposed fence avoid obstructing drivers' sight lines. One supervisor said the first fence (where two would be proposed) might help reduce drifting onto the roadway, but emphasized that if a fence is outside the right-of-way the county’s regulatory authority is limited.
The board did not take formal action at the meeting. Members said they wanted a clear, written plan for fence location, height and materials and for the applicant and his attorney to coordinate with county staff before any permit or further approvals. Supervisors asked staff to keep the board updated as negotiations with Benny and his counsel progress.
The next procedural step is for the attorney, Benny and county staff to meet and return with a fence plan; the board also expected to consult or receive input from Secondary Roads before any formal county decision.
(Reporting note: the board referenced a prior Board of Adjustment meeting where the use was approved; supervisors said they had discussed setbacks and the need to avoid blocking sight visibility.)
