The Brandon Planning & Zoning Commission on April 2 tabled a conditional‑use application for a two‑unit attached dwelling at Cairo Place after staff and commissioners disagreed about how the municipal code treats twin homes and duplexes.
Tommy Hall, project manager for Thunder Creek, told the commission he seeks to build two attached units on a parcel currently recorded as a single lot and said the developer intends that each unit be sold separately. "We just want to have it zoned or conditional use for a twin home project," Hall said, identifying himself as the applicant and a nearby resident.
Commissioners and staff parsed the ordinance definitions. Staff and several commissioners noted a difference between a duplex (two units on a single parcel) and a twin home (two attached units, each platted to its own lot). Patrick, a city staff member, said the current code language and past staff interpretations are inconsistent, and that a twin home that results in separate parcels would, in practice, require rezoning to R2. "We can't give you conditional use to do that in an R1," Patrick told the applicant.
Neighbors also questioned the proposal and its process. Tim Mullen, who said he lives across the street, sought clarification on the difference between a twin home and a duplex; another resident (identified as Sturker) asked whether separate legal parcel descriptions would be provided if the property is subdivided.
Because the applicant had not submitted a site plan required under the conditional‑use procedures and because staff said the ordinance language needs clarification, the commission voted to table the item to the April 16 meeting so the applicant can provide the required materials and staff can consult with the city administrator and clean up the ordinance language.
Next step: the applicant was asked to supply a site plan and staff will return with recommended clarifying language about whether twin homes may be allowed in R1 via conditional use or require rezoning.
