"We're really trying to get all this done before that project continues so that it all can be done at once," a staff member said. The draft agreement requires the applicant to indemnify the town and provide insurance covering liability for the encroachment.
Board members asked clarifying questions about ownership and maintenance. Staff confirmed the traps would be underground within the right of way, have manhole access lids for periodic pumping, and that the property owner is responsible for construction and costs. The motion to approve the agreement passed by voice vote, with the condition the town attorney sign off on final language.
