Committee adopts technical amendments to condo/HOA statute and sends Senate File 1750 to judiciary

Chair Koegel opened the session by moving Senate File 1750 to the committee and invited Representative Honor to present the DE12 author's amendment.
"These final tweaks are, again, just some cleanup and a few agreements that were struck with stakeholders to get it in the best possible shape and prepare for Judiciary," Representative Honor said, summarizing the package as a set of technical corrections recommended by the Minnesota Bar Association.
The amendment removes a standalone Section 1 and relocates its single change elsewhere in the bill, updates the definition of "property manager," and clarifies that certain determinations should be made by written agreement of unit owners. The package adds a 30-day window for homeowners to contest fines or assessments and requires a 30-day written notice of the resolution of such disputes. It also refines disclosure requirements about master insurance policies and the need for independent HO-6 supplemental coverage to account for each unit owner's portion of deductibles.
Representative Bahner, who said the statute "hasn't been touched in 32 years," called the changes a useful set of clarifications for volunteer board members and residents who often serve without legal training. Representative Dotson and other members pressed on dispute-resolution mechanics; sponsors said other dispute processes already exist elsewhere in statute and that the DE12 narrows some timeframes to avoid indefinite obligations on boards.
Members voted to adopt an oral amendment (delete Section 10) and then approved the DE12 as amended. The committee then approved sending Senate File 1750, as amended, to the committee on Judiciary, Finance and Civil Law.
The committee recorded the action by voice vote; no roll-call tally was provided. The measure will next be considered in Judiciary, Finance and Civil Law.
