Board approves right‑of‑entry and adopts resolution of intent for emergency access road at Los Gatos High
Summary
The board approved a right‑of‑entry agreement allowing Summerhill 50, LGSR LLC to construct an emergency vehicle access road and adopted a resolution of intent to grant a mutual easement for emergency access between Summerhill, the district and Santa Clara County Fire; the resolution starts a 60‑day public notice and hearing process.

The board approved two related items to allow construction of an emergency vehicle access road (EVA) that will connect the Summerhill Homes development to the north side of the Los Gatos High School campus.
District staff explained the right‑of‑entry agreement authorizes Summerhill crews to enter district property to construct the EVA under previously agreed cost‑sharing terms. Staff said the Department of State Architect provided final approval for the road plans and that construction could begin with pre‑construction and some demolition as early as May, with intensive work taking place over the summer and completion before the next school year.
The board also adopted a resolution of intent to grant a mutual easement to Summerhill and the Santa Clara County Fire Department that would permit emergency vehicles to cross district property and the Summerhill parcel. Staff described the statutory process: adopting the resolution of intent opens a 60‑day public notice period and requires a public hearing at the next meeting; the final grant of easement would require a subsequent vote and a two‑thirds board approval (four of five trustees).
A right‑of‑entry motion and a separate motion to adopt the resolution of intent were each moved, seconded and approved by roll call. Trustees said the easement will also serve as an evacuation route when needed. District staff said they will post required notices and bring the formal grant of easement to a future meeting for approval.
The board also approved the summer 2026 facility project list in the same meeting, authorizing staff to begin planning (with individual contracts and bids to return for approval later).
