Council directs staff to advance Athens refuse amendment and Prop 218 notices as solid-waste rules shift

Andrea (staff) and Public Works director Andy Winie explained the new amendment responds to recent industry realities: the Long Beach waste-to-energy facility has closed and several area landfills are no longer available, and state rules (SB 1383) require broader three-stream collection and other diversion measures. Staff said the amendment removes the obsolete transformation (waste-to-energy) target, adjusts diversion language and proposes extending the contract term to June 30, 2036 to preserve service continuity.
The amendment also formalizes three-stream collection (trash, recycling, organics) for all customers, contains provisions for roll-off services following a required notice period, and continues city benefits that staff described as "value-added" (four bulky-item pickups per week, household hazardous-waste events, compost giveaways and free city facility pickups). Andrea said Prop 218 notices had been mailed to residential and commercial customers as required for rate consideration.
Athens executives said they will continue to pilot equipment transitions (including electric-vehicle testing as the industry evolves) and to support the city's SB 1383 procurement targets. After questions from council about EV truck timelines and rate-indexing, council directed staff to prepare the formal amendment and submit it for the May 19 public hearing under the Prop 218 schedule.
Next step: staff will return to council on May 19 for the public hearing on proposed rate adjustments and final amendment adoption; the amendment includes rate-index mechanisms and fidelity to state mandates.
