SACO — The Planning Board granted preliminary subdivision and site plan approval on April 7 for the proposed 14‑lot residential subdivision at 196 Jenkins Road (Map 91, Lots 01 and 16), adopting findings and conditions and voting 5‑0 with one abstention on final action.
Applicant engineer James Lowry (BH2M, representing Misian Development LLC) told the board that a reinspection of the site after snow melt identified three small wetland pockets, including a roughly 385‑square‑foot pocket along the proposed Lot 5 right‑of‑way. That additional impact increases the total wetland impact above the 4,300 square‑foot threshold that triggers the Maine Department of Environmental Protection (DEP) Natural Resources Protection Act (NRPA) Tier I permitting process.
Lowry said the two larger pockets at the south portion of the site could be avoided by shifting clearing and grading limits northward toward a hammerhead turnaround; the small wetland along Lot 5 would be directly affected by the proposed road alignment and will require permitting. "With the additional 385 square feet of wetland impacts, that will push us over the 4,300 square foot threshold to require a Tier I NRPA permit," Lowry reported to the board.
City staff and peer reviewers had provided a series of review memos. The board adopted draft findings and conditions with several edits requested by members, including clarifying lighting and vehicular circulation findings and correcting a condition language typo. The board also removed one condition that mistakenly referenced private sewer facilities after staff confirmed the site ties to the city's gravity sewer system.
The board then voted to grant preliminary subdivision and site plan approval subject to the adopted conditions. The vote passed 5‑0 with one recorded abstention. The applicant must pursue the required state NRPA permit for the wetland impacts and finalize revised plans consistent with peer review comments before final subdivision approval.
What happens next: Applicant to secure a Tier I NRPA permit and submit final subdivision materials addressing peer reviewer comments and conditions of approval. Staff will circulate the updated materials to peer reviewers and city departments for verification.
