March 12, 2026 — The Eagle Pass commission approved a conditional use permit on Friday for construction of a duplex at 1991 King Arthur Street, allowing the project to proceed without a permanent rezoning of the parcel.
Staff explained that the lot is currently zoned R2 and that a duplex is ordinarily treated as an R3 use; approving a CUP lets the commission allow the duplex for this specific project without changing the city’s underlying zoning maps. Staff said the CUP is a faster, project-specific route and noted other nearby properties are already being used in duplex-like ways without formal permits.
One commissioner expressed concern that using CUPs rather than rezoning could create a perception of special treatment, and asked whether the city should change zoning more broadly. Staff responded that any property owner may apply for a CUP and each application is considered on its merits.
During public comment a nearby resident asked whether the builder would be required to put a fence around the property. Staff said the ordinance does not require a full fence for this residential duplex and noted that a picket fence already exists; staff added that plan review will ensure parking fits inside the property lines and that code enforcement can issue citations if adjacent private lots are used improperly.
The public hearing closed at 5:55 p.m. A motion to approve the duplex CUP was made and seconded; one commissioner announced an abstention and the meeting transcript records the result as "two in favor, one abstain."
