Wetlands agency directs staff to issue jurisdictional ruling for 10 Rita Lane pool

The Milford City Wetlands Agency on May 6 directed its designated agent to issue a jurisdictional ruling for IW260031, a pre-application to install a 15-by-24-foot above-ground pool and a 14-by-10-foot deck at 10 Rita Lane.
Staff told the agency the property sits in an AE flood zone and that the proposed pool and deck would be roughly 16–17 feet from a wetland line flagged by professional wetland scientist Steve Danzer. Staff noted the applicants plan to use a cartridge filter system that would avoid pool backwash and said the excavated material would be placed outside the upland review area. The filing noted that the site includes a drainage easement and that no fill will be placed in the floodway.
Applicant Stephanie Brower introduced herself for the record and told commissioners the proposal is limited to the deck and the above-ground pool. “We’re just doing the deck, the pool,” she said.
Commissioners and staff said the file included a wetland flag from Steve Danzer that clarified the buffer and reduced uncertainty. Commissioner Brian Black moved that “the designated agent issue a jurisdictional ruling for the pre-application IW260031 10 Rita Lane for the installation of a 15 foot by 20 foot above ground pool and a 14x10 foot deck as sketched on Steve Danzer’s PhD and Associates LLC map in the file,” adding in his motion that “this action will not have any impact or effect on the physical characteristics of the adjacent wetlands and water courses.” The motion was seconded and carried on a roll-call vote.
By the roll call recorded in the meeting, all commissioners present voted in favor; there were no recorded votes against or abstentions on this motion. The chair congratulated the applicants and the agency moved on to the next agenda item.
The ruling does not change flood-zone constraints noted on the file; staff reiterated that fill is not permitted in the floodway and that the cartridge filter proposal is intended to avoid discharges to wetlands. Any further permit conditions or final approvals will follow the designated agent’s ruling and any applicable administrative review.
