Applicant withdraws biochar special-review permit; Weld County rescinds USR24-0019

Weld County’s Board of County Commissioners on March 2 accepted a request to withdraw Use by Special Review permit USR24-0019, which had been approved Nov. 5, 2025 for biochar and related composting operations.
Diana Ans of the Department of Planning Services told the board the applicant, NGL Water Solutions DJ LLC, submitted a withdrawal letter dated Feb. 5, 2026 stating that the company no longer intends to pursue the uses described in the permit at this time though it did not waive the right to pursue a similar application in the future. The landowner, Blackfoot Properties LLC, also submitted a withdrawal email Feb. 13, 2026. "Please accept this letter as NGL Water Solutions DJ LLC request to Weld County's Department of Planning and Department services to vacate and terminate in its entirety the USR240019," Ans read from the record.
Planning staff recommended revocation/withdrawal and noted a final USR map had not been recorded. The board voted to approve the withdrawal and rescind the earlier resolution approving USR24-0019.
Why this matters: the withdrawal removes a previously approved special-review authorization for industrial-scale biochar/composting uses from county land records; the applicant said plans have changed and the company is not pursuing the project now but reserved its right to reapply.
Next steps: the county will rescind the resolution associated with the USR and staff will close the matter unless a new application is filed.
