City Attorney Audrey Bingham said the agreement was edited in three places: (1) paragraph 1.11 now states Bloomington will not be responsible for permitting after the date of transfer and that INDOT will work with the city on permitting during the transfer period; (2) paragraph 1.7 was revised to make clear the city had not yet inspected the roadway and that the city will accept the transfer in AS-IS condition after inspection; and (3) a ministerial correction to a board member’s name.
After the changes were explained, the board moved, seconded and voted to approve the agreement. The vote recorded Cox Deckard and Coron voting in favor and the motion passed.
Staff did not provide additional financial terms in the discussion recorded in the transcript; any remaining inspection-based acceptance conditions will be addressed as the city completes its inspection process.
