Board grants completeness waiver for Church Street Properties application

The Board of Adjustment of the Township of Bernards voted to grant a completeness waiver for Church Street Properties (ZB25032), allowing the application to proceed without an updated Letter of Interpretation for wetlands. Rob Simon, attorney for the applicant, told the board the submission included an environmental impact statement and a wetlands consultant’s report concluding there are no wetlands or transition areas on the property.
Board planning and engineering memos were discussed; the board’s professionals said the applicants’ expert materials justify the limited waiver for completeness. The board noted that an LOI could be required later as a condition of any approval. The motion to waive the LOI and deem the application conditionally complete was made, seconded and approved by voice vote.
The board asked the applicant to work with town staff on scheduling the formal hearing and to supply any additional exhibits identified by the township planner.
The board recorded the decision as a procedural completeness determination; any substantive permitting or environmental conditions will be addressed during the full hearing.
