Hood County reviews Aqua Texas Canyon Creek discharge; TCEQ investigating cleanup

Hood County environmental staff briefed commissioners on a timeline of repeated incidents at the Canyon Creek wastewater plant, operated by Aqua Texas, and on an April 2026 discharge that county and state investigators continued to assess.
Staff told the court the plant had documented capacity problems dating to 2022 and noted a 2025 TCEQ enforcement action. According to the county presentation, the April discharge was reported to have occurred for one day, on 04/27/2026, and cleanup and remediation work was underway with contractor MagnaFlow. "The discharge stopped on 04/27/2026," the county read from TCEQ correspondence during the briefing, and staff said a follow-up investigation was in progress.
Environmental staff outlined prior incidents reported to TCEQ and described repeated concerns about system flow, sludge disposal reporting and infiltration/inflow (I&I) that can overwhelm collection and treatment systems. Staff said the Canyon Creek plant is sized for approximately 42,000 gallons per day but that operations and tap loads in the subdivision have been reported at much higher volumes in recent months—county representatives told the court that they were seeing evidence of flows far above the permitted capacity and that Aqua Texas was trucking excess sludge off-site while pursuing a permit to expand.
County staff also said the Brazos River Authority sent courtesy notices to nearby lake permit holders and that local dock owners were being notified for situational awareness. The county reported receiving some documentation from TCEQ and BRA and said that remedies ordered or recommended by those agencies are being monitored. Staff confirmed the company has contracted MagnaFlow to perform remediation and that TCEQ was assessing potential violations and any civil enforcement actions.
Commissioners emphasized their interest in tracking the ongoing investigation and in clear communication to residents about water and public-health implications. The county said it will continue to request updates from TCEQ and the Brazos River Authority and will seek documentation of cleanup measures and manifests for hauled sludge where available.
