Rexburg council accepts donated ice rink, updates procurement rules and approves construction and grant awards

Rexburg City Council conducted a series of administrative actions and votes on May 6 following an earlier joint work session with Planning & Zoning.

Ice-rink donation and budget entry: CFO Matt Nielson told council the donated ice-rink facility had been appraised at $5,144,000 and that, under GASB accounting rules, the city must record the contributed capital asset and corresponding contributed revenue. The council moved, seconded and approved a budget adjustment to record the asset so the city can begin capitalizing it.

Procurement procedure update: Nielson then summarized proposed changes to the city’s procurement handbook to align with recently amended state procurement statutes. Key changes raise informal bid thresholds (moving the lowest informal threshold from $5,000 to $10,000), clarify quote/exception procedures between $10,000–$50,000 and create semiformal and formal thresholds aligned with state law (semiformal starting around municipal thresholds and formal advertising at higher amounts). Council discussed internal controls and documentation for exceptions and approved Resolution 2026-06 to adopt the revised procurement procedures.

Construction contract award (L55): Public Works Director Keith Davidson reported four bidders on the L55 contract and recommended award to low bidder JM Concrete ($3,294,540). Council approved the award and staff confirmed the contract includes time provisions (200 calendar days) and liquidated-damage language; Public Works will monitor schedule and apply liquidated damages if warranted.

Water-conversion grant (Porter Park): Public Works presented and council approved a 50/50 grant agreement with the Idaho Water Resources Board to convert Porter Park irrigation from culinary water to canal (service) water, a change intended to reduce potable water use for parks.

Surplus property and appointment: Council approved surplusing a 1997 Ford Ranger and an EasyGo golf cart. The council also ratified Chad Richards as a member of the city–county airport board.

Public comment and follow-up: During public comment two residents raised concerns about incorrect GIS displays on the city’s website and a commissioner’s conduct in a prior Zoom hearing. City legal staff responded that the GIS layer is a visual reference and not the controlling legal document—the ordinance is controlling—and said, after review, there was no legal basis to reopen the earlier hearing. The council and staff agreed to examine public concerns and document decisions in the administrative record.

Next steps: Several code and comp-plan items discussed in the earlier work session were deferred for redrafting and additional work sessions. Several administrative approvals require follow-up by staff to complete contracts, record deeds for the donated asset, and implement procurement-policy changes.
