Bradley Shman of the Office Legislative Council presented amendment version 3.1, telling members that the change adds a repeal section. "This repeal section would repeal the rulemaking authority in 7 VSA 855812," Shman said, and explained the amendment would repeal the authority to waive or reduce licensing fees for craft processors effective Jan. 1, 2028. He told the committee that "if the Cannabis Control Board does chooses not to do rulem, then they lose the authority. If they do choose to do rulemaking, they have to get legislative authorization." After the presentation, a member moved that the committee find amendment draft 3.1 to S.323 favorable. The clerk conducted a roll call and the committee recorded that the amendment was found favorable; the committee then took up the underlying bill as amended. Representative Campfield moved that the committee find S.323 favorable as amended; a roll call was taken and the committee voted to find the bill favorable as amended. Several members were recorded voting in favor and several members were noted as absent in the roll call.
The amendment’s repeal of the rulemaking authority in 7 VSA §855812 would mean the Cannabis Control Board could not exercise that specific authority beyond the repeal date unless the Legislature authorizes it.
