At a special called meeting, the Franklin City Council voted to enter a closed session under Virginia Code §2.2-3711(A)(1) to interview prospective candidates for employment and later reconvened and certified the closed meeting before adjourning.
The Chair asked the council to consider the agenda for the special call meeting; a council member moved to approve the agenda and the motion carried by voice vote. The Chair then asked for a motion to go into closed session. "I move that the city council of Franklin, Virginia convene a closed meeting pursuant to Virginia Code section 2.2-3711(a)(1) for the purpose of discussion, consideration, or interviews of prospective candidates for employment," a council member said. The motion was seconded and the council voted to enter closed session by voice vote.
The closed session was held under the exemption in Virginia Code §2.2-3711(A)(1), the statute that permits closed meetings for the discussion and evaluation of prospective candidates for employment. After the council returned to open session, a council member moved that each member certify that, to the best of their knowledge, only public business matters lawfully exempted from open meeting requirements and identified in the motion authorizing the closed meeting were discussed. Each member responded, "I certify." The Chair recorded the certification in accordance with Virginia Code §2.2-3712.
