Fruit Heights City Council adopted Ordinance 2026-02 (Title 10, CWUI/WUI) after a planning-staff presentation and a recommendation from the planning commission. Council member Blake Winslow moved to adopt the ordinance as amended; Council member Gary Anderson seconded, and the motion passed on a roll-call vote recorded as unanimous among members voting.
Planning staff told the council the ordinance and map were prepared to meet new state requirements and that city mapping aligns with the state boundary such that no existing city buildings fall inside the WUI area. Staff said the law’s updated definitions and mapping removed prior non-negotiable fees that had been a concern in earlier drafts. The ordinance will be submitted to the state after council approval, and the city’s fire marshal has reviewed the measure, staff said.
Council discussed the technical effect of the map on properties near the city edge and confirmed existing sensitive-lands landscaping standards in the mapped area help meet state requirements. Staff emphasized that properties already developed are not being required to retrofit landscaping or remove improvements as part of this action.
The ordinance was introduced as part of the planning commission’s public hearing record; planning staff said there were no public commenters at the planning commission hearing on this item. The council’s formal adoption closes the local approval step and triggers staff filing with the state.
