Council adopts paving-district amendment after debate over 80/20 assessment split

The North Plat City Council adopted Ordinance 4216 on second reading April 7, amending Ordinance 4208 to reconfigure Paving District No. 842 on Francis Street and to reduce the acreage subject to assessment from 261 acres to 28.74 acres.
Council debate centered on assessment allocation and fiscal risk. Councilmember Brad said he viewed the reduction as a significant increase in risk to taxpayers because it removes 89% of the previously assessed collateral, likening the change to a lender reducing the collateral behind an existing loan. Other councilmembers and staff said the change was requested by the developer to simplify the payment structure and that the apartment developer had agreed to carry 80% of the assessment; they also noted that the redevelopment agreement and TIF structure already obligate the developer to fund the road work and that the council retains options (including assigning 100% assessment to the apartments) if conditions change.
Staff advised that the 80/20 allocation reflected the largest assets being built on the higher-assessed side and that paving districts have a first lien on properties. Councilmembers asked for and received assurances that any amended redevelopment agreement would be reviewed before third reading; some members asked for the amended redevelopment agreement to be available to the council for review prior to further action. After discussion the council called the question and adopted the ordinance on second reading.
The ordinance change will be recorded and the council directed staff to provide the amended redevelopment contract and supporting documents for further review.
