Council approves conditional use permit for adult daycare hub in Midway

The Midway City Council on May 5 approved a conditional use permit for Innovative Harbor, an adult daycare to be located at 15 South 700 East in the city’s C-2 commercial zone.
Planning Director Michael Henke told the council the proposal includes an existing mixed-use residence where adults with disabilities would live and a detached structure to house the daycare. Henke said the state will set the facility’s maximum participant capacity under state licensing rules, and the city could limit only the daycare portion of the site, not the residence.
Applicant Jonathan Burton said the program would operate roughly 9 a.m. to 3 p.m. with occasional evening activities, would likely employ five to six staff, and requested allowance for up to 20 participants including residents. Burton said the facility would be a community hub offering events, arts and crafts, skills training and outings, and that the residential portion would house up to eight residents.
Two public commenters voiced support. Diane Moore said her daughter is a client of the applicant’s company and described the program as responsible and commendable. Erin Sabey said the program helped her two daughters generalize skills and provided family support.
Council Member Andrew Osborne moved to approve the conditional use permit with findings that the adult daycare is a conditional use in the C-2 zone, the property is mixed-use, and the State will determine the maximum number of participants; Council Member Andy Garland seconded. Council Member Osborne later offered an amended motion adding conditions that limited daycare hours for the outbuilding to 9 a.m. to 10 p.m. (with evening hours as the exception rather than the rule), capped total clients (including residents) at 20, and allowed parking to be reevaluated if it became a problem. The amended motion passed with all present council members voting aye (Council Member JC Simonsen was excused).
Next steps: state licensing officials must complete their inspection and set the facility’s licensed capacity; city staff will monitor parking and may require reevaluation if issues arise.
