Board advances Elm Lane seawall work after court order; costs assigned to property owners

The Clerk reported the court directed replacement of 540 feet of seawall, replacement of the guardrail and restoration of a five-foot strip of land. Trustee Brian Batkins offered and Treasurer Lawrence Tomenello supported Resolution No. 1 to establish an Elm Lane Seawall Installation Special Assessment District and to request that the township engineer prepare plans and cost estimates.
The meeting minutes state estimated project costs per parcel: $6,848.14 for Elm Lane parcels and $13,696.29 for Pointe Rosa parcels (the Clerk’s summary indicated the cost would be divided 50% by lot owners on the west side of Pointe Rosa and 50% by lot owners on Elm Lane in accordance with the court order). The board adopted Resolution No. 2 to set the date for the first public hearing on the proposed special assessment (May 26, 2026), to publish required notices and to advise owners of the right to protest and appeal to the State Tax Tribunal.
The resolutions were recorded as adopted with AYES: Kenneth Verkest, Adam Wit, Lawrence Tomenello, Brian Batkins, David Bratto and Dean Olgiati; NAYS: none; EXCUSED: Liza Brown. The next steps are engineering plans and the May 26 hearing on the assessment roll.
